By accessing analytics.restaurant (“Platform”), purchasing any reports, or using any data products, you agree to be bound by these Terms of Use & Data License (“Terms”). If you do not agree, do not use the Platform.

1. About analytics.restaurant

Analytics.restaurant is an independent data and market intelligence platform focused on the restaurant technology ecosystem.

We are not affiliated with, endorsed by, or partnered with any companies referenced in our reports.

2. Products & Access

All products are digital data products, delivered via:

• Access within a secure user dashboard, and/or
• Downloadable files (e.g., PDF reports)

Access is granted immediately upon successful payment.

Downloadable files are provided for convenience. The primary value of the product is access to structured data and analysis.

We reserve the right to:

• Limit or restrict downloads
• Regenerate or revoke access links
• Monitor usage for abuse, excessive downloads, or unauthorized sharing

3. Accounts & Access Control

To access purchased content, users are required to create an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity under your account

We reserve the right to suspend or terminate access if misuse, sharing, or suspicious activity is detected.

4. Purchases & Payment

• Payments are processed securely via Stripe
• We do not store or process your payment details
• A receipt is automatically issued upon purchase

By completing a purchase, you confirm that:

• You are authorized to use the payment method
• You understand that the product is a digital, non-returnable good

5. License & Permitted Use

Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to use the content for:

• Personal use
• Internal business use

You may:

• Share content internally within your organization

You may NOT:

• Resell, redistribute, or sublicense the reports or data
• Share content externally outside your organization
• Publish, reproduce, or commercialize the data without permission
• Build competing datasets, products, or services using our data

We reserve the right to revoke access in cases of violation.

6. Data Sources & Accuracy Disclaimer

Our reports are based on publicly available data collected from sources including, but not limited to: Google, Yelp, TripAdvisor, OpenTable, Resy, Tock, etc.

This data is aggregated, inferred, and analyzed using proprietary methodologies. As a result, reported figures may differ from internal or official data held by these platforms, which may include private datasets, APIs, or non-public information not accessible externally.

We make no guarantees regarding completeness, accuracy, or timeliness.

All data and analysis are provided “as is” for informational purposes only and do not constitute financial, investment, or legal advice.

7. Intellectual Property

All content, including but not limited to reports, datasets, analysis, visualizations, and website content, is the exclusive property of analytics.restaurant and protected by applicable intellectual property laws.

Unauthorized use, reproduction, or distribution is strictly prohibited.

8. Usage Monitoring & Enforcement

To protect our products and prevent unauthorized use, we may monitor:

• Account activity
• Report access and views
• Download activity
• IP address and device information

We may use this data to:

• Enforce these Terms
• Prevent fraud or abuse
• Support dispute or chargeback claims

9. Limitation of Liability

To the maximum extent permitted by law, analytics.restaurant shall not be liable for:

• Decisions made based on the data
• Indirect, incidental, or consequential damages
• Loss of revenue, profit, or business opportunity

Use of the Platform and its data is at your own risk.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

Refund Policy

1. No Refunds

Due to the nature of digital products, we do not offer refunds once access has been granted.

Our products are delivered instantly, accessible immediately, and non-returnable. Once access is provided, the product cannot be returned or revoked.

2. Exceptions

Refunds will only be issued in the following cases:

• You were charged but did not receive access
• Duplicate charges occurred due to a technical issue
• The product is technically unusable and cannot be replaced

3. Before You Buy

We encourage you to review report previews and included data descriptions before purchasing.

4. Chargebacks

We actively monitor and log account access, report views, and download activity.

If a chargeback is initiated, we reserve the right to dispute it with evidence of access and delivery.
